These Terms of Service ("Terms") govern your access to and use of bryankids.store (the "Site") and any order you place with Bryan Kids ("Bryan Kids," "we," "us," or "our"). By visiting the Site or placing an order, you agree to these Terms in full. If you don't agree with any part of them, please don't use the Site.

We sell and ship worldwide, so these Terms are written for customers ordering from anywhere. Section 16 explains how local law interacts with these Terms if you're ordering from outside the country we operate in.

1. AGREEMENT TO THESE TERMS

By using any part of the Site, you agree to these Terms and to our Return & Refund Policy and Privacy Policy, which are incorporated here by reference. Any new features or tools added to the Site are also subject to these Terms. We may update this page at any time — see Section 18.

2. ELIGIBILITY & ACCOUNT USE

Our products are made for kids, but the Site itself is intended for use by adults. You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. If you're ordering on behalf of a minor, you're confirming that you're their parent or legal guardian and that you accept these Terms on their behalf.

If you create an account with us, you're responsible for keeping your login details confidential and for all activity under your account. Please let us know right away at contact@bryankids.store if you suspect unauthorized use of your account.

3. PRODUCTS, PRICING & AVAILABILITY

We try to display product colors, sizing, and details as accurately as possible, but we can't guarantee that your screen will show colors exactly as they appear in person. Sizing guidance is provided to help you choose, but fit can vary between styles.

Prices are shown in the currency displayed at checkout and may change at any time without notice; a price change won't affect an order you've already placed and paid for. Depending on where you're ordering from, your total may include sales tax, VAT, or import duties, either collected at checkout or due on delivery — see Section 06.

We reserve the right, at our discretion, to limit quantities, discontinue a product, or refuse any order. If an item you ordered turns out to be unavailable or mispriced due to an error, we'll contact you before charging you and give you the option to cancel or adjust your order.

4. ORDERS & PAYMENT

Placing an order is an offer to buy, which we accept when we confirm and process your order — not simply when you receive an order confirmation email. Payment is processed securely through our payment providers at the time of purchase; we don't store your full card details ourselves.

You agree to provide current, complete, and accurate purchase and account information for all orders. If a payment is declined, disputed, or reversed after your order has shipped, we may take reasonable steps to recover the cost of the goods, including working with our payment providers.

5. SHIPPING & DELIVERY

We ship to destinations worldwide. Estimated delivery times shown at checkout are our best estimate, not a guarantee — actual delivery can be affected by customs processing, carrier delays, and local conditions once a package leaves our hands.

For international orders, you're responsible for any customs duties, import taxes, or brokerage fees charged by your country on arrival; these are set by your local authorities and aren't included in our prices unless stated otherwise at checkout. Refusing a package to avoid these fees may result in the order being treated as a return, with return shipping and customs costs deducted from any refund.

6. RETURNS, EXCHANGES & REFUNDS

Returns, exchanges, and refunds are governed by our separate Return & Refund Policy, which forms part of these Terms. It covers the return window, condition requirements, who pays return shipping, and how refunds are issued.

7. ACCEPTABLE USE

When using the Site, you agree not to:

- Use the Site for any unlawful purpose, or to violate any law in your jurisdiction
- Attempt to interfere with, disrupt, or gain unauthorized access to the Site, our servers, or any connected network
- Use automated means (bots, scrapers) to access or extract data from the Site without our written permission
- Submit false, fraudulent, or misleading information when placing an order
- Upload or transmit viruses or any other malicious code
- Harass, abuse, or harm another person through the Site, including through reviews or messages

We may suspend or terminate your access to the Site, and cancel any pending orders, if we reasonably believe you've violated these Terms.

8. REVIEWS & USER CONTENT

If you submit a product review, photo, question, or other content to the Site, you confirm it's your own, that it doesn't infringe anyone else's rights, and that it doesn't contain anything unlawful, obscene, or defamatory. You grant Bryan Kids a non-exclusive, royalty-free, worldwide license to display, reproduce, and use that content in connection with the Site and our marketing, without any obligation to compensate you.

We may remove any content, at our discretion, that we believe violates these Terms or is otherwise inappropriate. Please don't include personal information about children (your own or anyone else's) in a public review.

9. INTELLECTUAL PROPERTY

The Site and its original content — including the Bryan Kids name and logo, product photography, graphics, and text — are owned by or licensed to Bryan Kids and protected by copyright and trademark law. You may view and download material from the Site for your own personal, non-commercial use only. You may not reproduce, republish, or resell any part of the Site or its content without our prior written permission.

10. THIRD-PARTY LINKS & TOOLS

The Site may link to third-party websites or use third-party tools (for example, payment processors or shipment tracking services) that are not owned or controlled by Bryan Kids. We're not responsible for the content, policies, or practices of any third-party site or service, and linking to them doesn't imply our endorsement. Any use of third-party tools is at your own risk and subject to that provider's own terms.

11. PRIVACY

Your use of the Site is also governed by our Privacy Policy, which explains what information we collect and how we use it. By using the Site, you consent to that collection and use.

12. DISCLAIMER OF WARRANTIES

The Site and all products are provided "as is" and "as available," without warranties of any kind, express or implied, except where required by law. We don't guarantee that the Site will be uninterrupted, error-free, or entirely secure. Nothing in this section limits any warranty or consumer guarantee that applies to your order under mandatory law in your country of residence.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Bryan Kids won't be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or your purchase of a product, even if we've been advised of the possibility of such damages. Where liability can't be excluded under applicable law, our total liability to you is limited to the amount you paid for the order giving rise to the claim.

Note: Some jurisdictions don't allow the exclusion or limitation of certain damages or warranties — in that case, the limitations in this section apply only to the extent permitted where you live.

14. INDEMNIFICATION

You agree to indemnify and hold Bryan Kids, its team, and partners harmless from any claim or demand — including reasonable legal fees — arising from your breach of these Terms or your violation of any law or the rights of a third party.

15. GOVERNING LAW & DISPUTES

These Terms are governed by the laws of [INSERT BRYAN KIDS' COUNTRY/STATE OF REGISTRATION — e.g. the country where the business is legally established], without regard to conflict-of-law principles, except where mandatory consumer protection law in your own country of residence gives you additional rights or requires a different result — those rules take priority for you as a consumer.

16. GENERAL TERMS

If any part of these Terms is found unenforceable, that part will be limited to the minimum extent necessary, and the rest will remain in full effect. Our failure to enforce any right or provision here isn't a waiver of that right. These Terms, together with our Return & Refund Policy and Privacy Policy, are the entire agreement between you and Bryan Kids regarding the Site and your orders.

17. CHANGES TO THESE TERMS

We may update these Terms from time to time — for example, to reflect a change in how we operate or to comply with new legal requirements. The version posted here at the time you place an order is the one that applies to it. We'll update the effective date above whenever we make a material change.
